RuleMailer Terms of Use
Through RuleMailer (“The Service”) Rule Communication – Nordic AB (“RC”) provides web site operators and other individuals a variety of tools and resources to collect visitor e-mail addresses and to create, launch, and manage online e-mail campaigns.
This service may not be used for the sending of unsolicited e-mail (sometimes called “spam”). See our Anti-Spam Policy. The following are the terms and conditions for use of the Services. By checking the “I have read the RuleMailer terms of Use statement. I accept these terms and conditions” box on the Order page or after logging in for the first time, you (“The Customer”) confirms that this contract regulates the conditions between the Customer and RC.
Service
RC is responsible for the proper installation and maintenance of the Service. Maintenance includes backup of system files, database information, and assuring that software and hardware is optimized for The Service.
RC reserves the right to, without advance notices, limit or restrict the access to The Service, or The Service’s features, if RC determines that such actions are necessary due to service and/or security related circumstances.
Contract Time
The license is valid throughout the license period, starting from the date The Service is installed and can be used by the customer. The date is specified on the first page. If The Service is not cancelled at least three months before the end of the contract time, the contract will be automatically renewed on a year-by-year basis, with a mutual three-month notice period for cancellation of The Service. The cancellation of The Service must be done in writing with a physical letter to RC. The customer pays the subscription in advance, one year at a time. The first payment is done when The Service Agreement is accepted and the customer signs up for The Service.
The Customer’s Responsibilities
The customer shall, in writing, notify RC if the invoice address changes. The customer is responsible for the material the customer makes available on the Internet. The customer is responsible for all content in the customer’s correspondence, the content of the customer’s web pages or other activities which the customer may have on the Internet. The customer is responsible for maintaining proper IT-security.
RC’s Responsibilities
RC is responsible for The Service’s function. RC has no responsibility for legal or illegal surveillance, collection, intrusion, or other activities that may affect the customer’s traffic, communication or data. RC does not take any responsibilities for possible damage (financial or other) which can be attributed to problems with The Service.
Termination of Subscriptions & Illegal Use
RC reserves the right to terminate subscriptions if the customer has not paid invoices before specified due dates after reminders. RC has the right to immediately terminate subscriptions without obligation of returning payments if the customer abuses The Service or subscription. The dissemination of information which violates Swedish law, such as child pornography, slander and defamation, or statements which may be considered agitation against particular groups of people, are examples of abuse.
Force Majeure
RC is not responsible for problems, damage, or loss caused by circumstances beyond RC’s control.
Examples of circumstances, without providing a complete list, are work conflicts, loss of power, lightning, fire, atmospheric disturbances, events of law, governmental measures, war, strikes or similar events, disturbances at RC’s providers, or delays in Internet-connected networks.
Conflict
Conflicts regarding the interpretation or application of this contract or associated legal conditions shall be determined by Swedish law.
Ownership
RC reserves all rights for hardware and software for The Service, while the customer owns its content in The Service. The content may be transferred to RC in event of unpaid bills, bankruptcy, etc. The Service will be transferred to the customer in the event of bankruptcy, if no other actions can be takes to maintain full Service functionality.
